Sample Dispute Resolution Clause

In the event that any dispute shall occur between the parties hereto that cannot be resolved by agreement between the parties within [ ] days of written notice of the dispute being given by one of the parties to the other, then the determination of the dispute shall be arrived at by alternative dispute resolution. Such dispute shall be determined by a single mediator if the parties can agree upon one, and the mediator's fees and any other costs associated with the mediation shall be borne equally by both parties. If a single mediator cannot be agreed upon by the parties, each party shall be entitled to appoint a mediator and to pay its own costs associated therewith. The dispute resolution shall proceed in such manner as the mediators and the parties shall determine. In the event that the dispute cannot be settled within sixty days of the appointment of the mediator or mediators, then the dispute shall be resolved by arbitration. Such arbitration shall be determined by a single arbitrator if the parties can agree on one and the arbitrator's fees and any costs associated with the arbitration shall be borne equally by both parties. The arbitration shall proceed in accordance with the provisions of the Arbitration Act Cap. 110 of the Laws of Barbados, as amended from time to time, and any determination arrived at by the arbitrator shall be final and binding thereon. If the parties cannot agree upon a single arbitrator, either party shall be at liberty to commence legal proceedings.
